Terms of Service

1. Acceptance of Terms
By accessing or using zMesh (“the Platform”), operated by Zyora Labs (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you are using zMesh on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these terms.
If you do not agree to these terms, you must not use the Platform.
2. Platform Purpose
zMesh is a Backend-as-a-Service platform designed exclusively for lawful, productive, and constructive purposes. The Platform provides database, authentication, storage, serverless functions, real-time, and AI gateway services to help developers and organizations build legitimate software applications.
The Platform is not intended for, and must not be used for, any illegal, harmful, destructive, or unethical activity.
3. Account Responsibilities
- You are responsible for maintaining the confidentiality and security of your account credentials, API keys, and access tokens.
- You must notify us immediately at security@zmesh.in of any unauthorized access or suspected security breach.
- You are solely responsible for all activity that occurs under your account, including actions by team members you invite.
- You must provide accurate and truthful information during registration and keep it up to date.
- One person or entity may not maintain more than one free-tier account.
4. Acceptable Use Policy
You agree to use zMesh only for lawful, productive purposes. You must NOT use the Platform to:
- Illegal activities: Store, process, or distribute content that violates any applicable law, regulation, or court order in any jurisdiction.
- Malware & hacking: Develop, host, distribute, or facilitate malware, viruses, ransomware, trojans, keyloggers, botnets, or any malicious software.
- Unauthorized access: Attempt to gain unauthorized access to any system, account, network, or data — including other zMesh users' resources.
- Fraud & phishing: Conduct phishing campaigns, financial fraud, identity theft, credential harvesting, or social engineering attacks.
- Spam & abuse: Send unsolicited bulk messages, spam, automated scraping of other services, or conduct denial-of-service attacks.
- Harmful content: Store or distribute child exploitation material, non-consensual intimate imagery, terrorist content, or content that promotes violence or hatred.
- IP violation: Store, host, or distribute content that infringes copyrights, trademarks, patents, or other intellectual property rights of third parties.
- Surveillance: Build tools for unauthorized surveillance, stalking, tracking individuals without consent, or mass data collection of personal information.
- Circumvention: Attempt to bypass rate limits, usage quotas, security controls, or any technical restrictions on the Platform.
- Cryptocurrency mining: Use Platform compute resources (Edge Functions, AI Gateway) for cryptocurrency mining or proof-of-work operations.
Enforcement: Violations of this policy will result in immediate account suspension without prior notice. Severe violations (malware distribution, CSAM, fraud) will be reported to the appropriate law enforcement authorities. No refunds will be issued for accounts terminated due to policy violations.
5. Data Ownership & Intellectual Property
- Your data is yours. You retain all rights, title, and interest in the data you store on zMesh. We do not claim ownership of your content, databases, files, or function code.
- Limited license: You grant us a limited, non-exclusive license to host, store, and serve your content solely as necessary to provide the Platform services.
- Our IP: The zMesh platform, APIs, CLI, documentation, brand, and underlying technology are the intellectual property of Zyora Labs. You may not copy, reverse-engineer, or create derivative works from our platform.
- Feedback: If you provide feature suggestions or feedback, we may use them to improve the Platform without obligation to you.
6. Service Availability & SLA
- We target 99.9% uptime for all paid plans but do not guarantee uninterrupted service.
- Free-tier accounts are provided on a best-effort basis with no uptime guarantee.
- Scheduled maintenance will be announced at least 48 hours in advance via email and the status page.
- We are not liable for downtime caused by force majeure events, third-party service failures, or your own code/configuration.
- Service credits for extended outages on paid plans are at our discretion.
7. Billing & Payments
- Paid plans are billed monthly in advance through ZPay (operated by Zyora).
- You may upgrade, downgrade, or cancel your plan at any time from the dashboard.
- Downgrades take effect at the end of the current billing cycle. No partial refunds for the remaining period.
- We reserve the right to change pricing with 30 days advance written notice. Existing plans remain at the old price until the next renewal.
- Failed payments will trigger a 7-day grace period. After that, your account may be downgraded to the free tier.
- Refunds are handled on a case-by-case basis at our discretion.
8. API Usage & Rate Limits
- Each plan has defined API rate limits and resource quotas. Exceeding limits may result in 429 (Too Many Requests) responses.
- Persistent or intentional abuse of rate limits may result in temporary or permanent suspension.
- We may adjust rate limits with notice as platform capacity evolves.
- You must not use automated tools to circumvent rate limiting or quota enforcement.
9. Third-Party Integrations
The Platform integrates with third-party services (e.g., OAuth providers, payment gateways). These services are governed by their own terms and policies. We are not liable for:
- Downtime or changes in third-party APIs.
- Data handling by third-party OAuth providers you connect to your project.
- Payment disputes — these should be directed to ZPay or the underlying payment gateway.
10. Account Suspension & Termination
By you:
- You may delete your account at any time from the dashboard.
- Upon deletion, your data will be available for export for 30 days, after which it is permanently and irrecoverably deleted.
By us:
- We may suspend your account immediately and without notice for violations of the Acceptable Use Policy (Section 4).
- For billing issues, we will provide a 7-day grace period before suspension.
- For minor violations, we will issue a warning and give 48 hours to remedy before suspension.
- Terminated accounts due to serious violations (fraud, malware, illegal content) will have their data deleted immediately with no export period.
- We reserve the right to report illegal activities to relevant law enforcement authorities.
11. Limitation of Liability
- The Platform is provided “as is” and “as available” without warranties of any kind, express or implied.
- Our total aggregate liability to you for any claims arising from your use of the Platform is limited to the amount you paid to us in the 12 months preceding the claim.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or business opportunities.
- You are solely responsible for maintaining backups of your data. While we provide backups as a service feature, we are not liable for data loss.
12. Indemnification
You agree to indemnify, defend, and hold harmless Zyora Labs, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these terms, or your violation of any third-party rights.
13. Governing Law & Disputes
- These terms are governed by the laws of India.
- Any disputes will first be attempted to be resolved through good-faith negotiation between both parties.
- If negotiation fails, disputes shall be resolved through arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Hyderabad, India.
- Nothing in these terms prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction.
14. Modifications to Terms
We may update these terms from time to time. Material changes will be communicated via email and a prominent dashboard notice at least 30 days before taking effect. Continued use of the Platform after the effective date constitutes acceptance of the updated terms.
